      As for sue, it's likely the two men picked out of the line-up don't even know their lives were nearly ruined because, at that point, the police knew Smollett was lying and were just giving him rope to hang himself (since he apparently likes to do that shit). But Smollett didn't know at the time. In his head, these were two completely innocent men, and he pointed to them both and went "those are the men who attacked me, yes I'm sure, ruin their reputations, ruin their lives, throw them in prison on a hate crime and let them rot" just so he could get attention. It's sick.
