      The whole point was to play to Sauron's weaknesses. He's a demon who lusts for power, so it doesn't even occur to him that people who came across the Ring would want to destroy it instead of using its power for themselves. Their whole mission was playing a long con with Sauron to make him think that Gondor had taken the Ring and were planning on using it against him instead of sneaking it into Mordor to destroy it. They attack the gates of Mordor specifically as a ruse to make Sauron think that there's an overconfident ringbearer among them who thinks he can destroy all the armies of Mordor with nothing more than the power of the Ring. They know this will draw all the forces out of Mordor because Sauron thinks the army at the gates has the Ring and so his Eye will be fixed on them and not the two short people scaling Mount Doom.

                Because Gandalf is imprisoned in Orthanc for months, that's how long it takes for him to contact the eagles and forr Gwaihir to fly down to rescue him. If they sit around waiting for that long they will be set upon by Saruman's forces if they don't tear themselves apart due to the ring's influence, not to mention the risk of corrupting the eagles

              Saruman spots them even when they are travelling by ground as a small party. They would immediately be noticed even faster iif they were soaring through the air on giant eagles. Moreover putting the ring in contact with proud creatures like the eagles is a risk

    It wasn't a war crime because there was no law of war in middle earth. The only consequence for killing a messenger is that no quarter will be given to your messengers. They weren't planning on sending any.
