The chase scene is overrated. But if you're referring to the actual character going "down", all the evidence against him is circumstantial. He's only guilty of pointing a gun at someone. A gun that was given to him by another person. A jury will look at that sting operation and see it for the bullshit it is. Barry will spend two episodes in jail, tops.
Did Barry even check the gun before he tried to go kill the dude? I don't remember - if he didn't, that'd be ridiculously out of character
He didn't "check" it but nothing about the state of the gun matters. It's not like it was empty and he was tricked, he never attempted to fire the gun. I imagine there were bullets in the gun, as Barry would know the weight of a loaded gun.
