      Let's be real here. One of the points of prison is for society to unleash its desire to torment and inflict pain upon someone powerless. It's somewhat like the Purge, a safety valve for people to channel their desire for violence and sadism. That's why people cream themselves trying to justify why this woman needs to be thrown into a bunch of 80 IQ violent criminals (with maybe some trannies for company even), that's the real thing about it that people try to rationalize away with muh justice. We all know this woman was irresponsible but isn't a danger to society, and really, even if she killed someone, she should just get community service or pay a fine and be banned from working as an armourer or related professions.       The real answer is if you take her case independently there is no reason to imprison her, she is not a harm to society, the victim is already dead, it's a sunk cost. At a societal level however, if there is no punishment for the crime there is no deterrent for someone else to intentionally do the same thing she did since they will know that they will not be punished for it. Therefore you have to punish her to prevent the same thing from happening again.

            From what I read they were setting up a shot where he aims the gun in the camera's direction. That's why the director was lined up with the cinematographer to see what the shot would look like.

            It's dumb to deny that he pulled the trigger. He was told by the assistant director it was a cold gun and was brought from the armorers cart of firearms. The assistant director and baldwin both assumed it was a cold gun because of that.

      Under New Mexico law, when a firearm causes an injury or death, a charge of manslaughter only requires that ‘ordinary negligence’ occur rather than the more stringent ‘criminal negligence’.
      Drawing, wienering, aiming and triggering a firearm you have not verified as safe is ‘ordinary negligence’, especially seeing as neither the armorer nor one of her two assistants were present on the set.

      You can argue Baldwin’s level of culpability but under NM law he’s absolutely negligent. He could have filmed in CA where rules are different and this wouldn’t have happened, but he cheaped out and went to NM where rules are more relaxed.
      He could have asked for a replica or prop weapon. He could have unloaded the weapon. He could have pointed it off to one side instead of directly at two other people.

                You shouldn't expect actors to know how firearms work. It's not their job. That's why they hire safety crew like the armorer in the first place. They should just assume everyone is dumb and doesn't know how it works.

SAG guidelines put the ultimate responsibility on the actor to maintain a safe environment, and Baldwin himself spoke of his extensive experience with firearms in his police interview. In a different interview another actor on the same set talked about how he checks his gun is safe after being handed it each time. Lastly, every single production with firearms involved has mandatory safety courses for anyone who will be using a gun. Anyone in the industry long enough will sit through dozens of these, along with heading to firing ranges to practice. There is no expectation of incompetence with actors, and that's why there has been less than half a dozen firearm fatalities in Hollywood over the last 110 years, only two of them involving live ammunition; Rust and a 1915 film called The Captive.

They shoot films where prepubescent children and women fire guns ffs. But what you can expect is for an actor to act with a level of respect for the inherent danger posed by firearms.                 There is no such law. That anon is overstating his case if he thinks that an actor on a set is held to the same standard as you or I would be if we were just fricking around with a gun in your backyard.
                But that doesn't absolve Baldwin of his role in this accident, and his actions can still be judged as grossly negligent. It will come down to the fact that no one instructed him to fire the gun and in fact by his own admission he nevee intended to fire the gun. The discharge was entirely due to his own negligent handling. The sad reality is that had the director intended for Baldwin to fire his gun, the saftey officer most likely would not have broken protocol by handing the gun to Bladwin, and instead would have brought Hannah onto the set to do the normal final check before handoff.
                So while an actor on set is not held to the same standard as someone just playing around with a gun for fun or sport, that does not mean they are held to no standard, and they can not just start firing a gun if the rest of the crew is not anticipating and prepared for it.

                What they are saying is that it is negligent to accept the firearm from a person on set who does not have the responsibility of checking the gun, as you can not be sure if the gun was adequately inspected.                 No, you don't get to do that with a gun. That's where the comparison fails and actual context for how the industry works is needed.
                The actor gets to witness it being loaded by the armorer, or failing that, gets to ask for the armorer to open it and show that it is safe. That is a check. Baldwin in the police interview talks about how Reed would offer this but he would refuse. They both fricked up there, Reed for not setting him straight on safety and him for thinking double-checking her work is somehow rude.
                Alternatively, some actors dry fire the gun into the ground to be sure all chambers have dummies. That's also a check. Ackles, another actor on set, says that is his usual practice.
                Simply getting verbal confirmation is negligence. It's a deadly weapon, not a shelf. To put it another way: no reasonable person would put the gun to their own head and pull the trigger after only getting verbal confirmation.
                Just because it's a legal document does not mean the writer is a perfect automaton with exact definitions on mind for every word. The prosecutor and defense lawyers were both getting terminology incorrect all through the trial despite having worked on the case for so long. The difference between check and inspect is tiny compared to some of their mistakes.

Sure, it takes two seconds to check a revolver, but there are action scenes where actors are dumping full box magazines one after the other, take after take.       I don't know about girlprison but male prisons are a lot more chill than everyone thinks. I did three years in a state prison and in the first month we all got covid money and whatever money they gave everyone. So we all had 3.5k spend and everyone bought xboxs and TVs. It was basically 3 years of playing call of duty and halo 3 on lan and watching free cable. They would also play 6 new move releases every month on a dedicated TV channel so I got to keep up on all new movies. I didn't even know they were making a clerks 3 before it played on the channel.

      It wasn't so bad. The facility I was at was air conditioned too so I got lucky. Every other prison in the state is older and you have to deal with extremely hot summers and freezing cold winters. There are also a couple places that are just open dorms which would have sucked as you get no personal property. No tvs or xboxs there.

    There was a female juror in Florida the other day that recieved a 6 month prison sentence for intentionally causing a mistrial in a death penalty sentencing trial. Does that mean causing a mistrial is one third as bad as negligently killing someone? Or I guess one sixth as bad if you assume Baldwin gets the 18 months as well.
    I really don't understand sentencing.
