Simply being in black and white almost certainly won't be grounds for a successful lawsuit. They'll have to be very careful about which content they pursue because they'll run the risk of setting new case law and legal precedents that will work against their interests.

Under copyright law something like a Winnie the Pooh horror film would ostensibily be protected as parody even if Winnie the Pooh's appearances weren't in the public domain. Trademark infringement is the big question. If Disney owns the trademark and can prove that you're using it unlawfully or in such a way that damages their brand you would have a problem.
Disney already made that Once Upon a Time show where many beloved characters were evil.
This your first experience of this? All of Disneys classic movies are public domain stories, anon. Its why you still see pinochio and cinderalla etc getting made by pajeet studios, even still. Disney does not and never did own those IPs, and the shit adaptations of them do not invalidate the canon work which anyone can adapt however they see fit. Noone can own or carry on the story outside of their own version of it, its a finished work once it enters PD.
Theres countless Shakespeare movies, alot of them are fricking awful, theres even ones which try to make it modern with Black person speak and raps, this garbage existing does not mean it is now the new canon simply for existing.
PD exists so that companies (like Disney) cannot own someones creative work long after they are dead where they can just assign themselves as the new author, writing canon and rewriting the original work forever, going against the creators vision and views even, they cant say no so the company is the one who now draws the line on what is canon and what can be "fixed" in the original work because its theirs. PD is a way to put a full stop on the end of a legacy when the artist/original creator is dead, otherwise you get shit like people rewriting and writing sequels to the LotR as canon where their experience is simply that they were given permission from Amazon and have no writing credits to their name, but are now writing "LotR4:Aragorns transition" and have another 20 books in the works for which will all be canon, where they are the sole key holders of the IP forever doing this as though they were the actual author.
Public Domain saves a work by letting it end with its original creator.
Of course there will be lazy and exploitative c**ts who will take advantage of public domain properties to make cheap cash-ins. That downside pales in comparison to the potential for better content to be produced once audiences tire of lazy shock value crap. Shit is shit and shit is forgotten quickly, but the potential for average, above average, or even genuinely great content to be produced from properties in the public domain is too great to let go to waste.
More importantly the knowledge that rights will eventually go to public domain puts pressure (however little) on content producers to continue producing content instead of just rereleasing, repackaging, rehashing, rebooting, etc. There's a bill in consideration right now that would roll back corporate copyrights to 56 years and I think that's probably the best piece of legislation I've heard of in recent memory.
