they didn't have the rights to use John so they needed to create a new character. Gaiman did have the rights for Joanna Constantine though, John's distant ancestor who debuted in Sandman, so they made do.
The only "rights" problem is that of JJ Abrams calling dibs on the character for his never-finished projects. WB is getting back to the "character embargo" stage that they used to be in.
It's also why Matt Ryan's Constantine was removed from the last season of Legends of Tomorrow
