He is being charged and if the system works will also get convicted (even though he'll probably get probation and no jail time).

They found live rounds mixed into bandoliers that were being used to load guns, and she had a fanny pack mixed with an assortment of ammo she was swapping in and out of guns. And to arrange circumstances like that so that you'd have the perfect pretext to murder someone but pass it off as a negligent homicide are prohibitively convoluted. And there's no evidence he premeditated killing Hutchins.
