Bethesda copied a mod called Fallen Leaves and put it in as a side quest in Far Harbor (that vault murder mystery with robobrains) and never apologized or admitted to it. This LOTR fan fiction author was a fool for not understanding that America is a corporation and the justice system is entirely about how much money you have.

            As a software developer, that's how it is at a lot of companies. If you have side projects and the company finds out about them, they can claim ownership. That's also how it was at my university, with the school claiming anything I write is also their IP. This varies by state, country, and the specific employment contract you have. Look into Intellectual Property Policies.

                It's easy enough to do a trademark search and find that Conan is trademarked to an LLC with correspondent being New York israelite lawyer. The specimen filed to extend the mark is just a legacy rerelease of the Conan comic in 2018. That's what these people do, just squat on a mark and do the bare minimum to maintain it in the off chance somebody's dumb enough to try using it, then they sue the frick out of them.

Characters and stories have always been an important part of culture and the sharing of folklore was one of those things that help people bond as a society.             because GoogleBooks doesn't let you copy the text that you highlight, and even if I could find a addon or greasemonkey script that circumvents that, I would also have to construct some kind of Autohotkey script or something to manually copy the text of each individual page and paste it into Notepad or Wordpad or whatever, and that would take me alot longer than 15 minutes which is about the combined time it took me to simply screencapture every individual page while clicking with my fingers.           It's very hard to prove plagiarism, even harder when you are ripping off the works the person you're suing owns the rights too. In the US, if you don't defend your copyright legally, you lose it. This IDIOT was selling fanfiction that he has zero rights to. That's a direct threat to whoever owns the rights to LoTR. The fact this IDIOT sued them, thereby letting them know he has been threatening their copyright, makes him even more stupid.

        Lol no. That would just incentivize companies to make their own fanfics without ever involving the author or their estate. Make fanfic writers attack each other more ov alleged copying or being inspired by the other's work. Make fanfic writers sue more authors thinking they must've read their fanfic and stole their idea. And drive fanfic to be more profit based than it already is, commissions can now be litigious, AO3 is going down.

                Again he should have simply changed the fricking names in the book. Many author starts as fanfic writers like Sarah J. Maas.

                The reason he used LotR names is that he wanted to use the brand notoriety as a sort of marketing tool.

                Before publishing he simply had to change some of the names and terminology and voila he can publish freely, but would people BUY that Fanfic without LotR branding? Perhaps, but if you want it you have to pay to use a brand.

            Why do you assume they'd need to? They could hire writers to make up stories from any IP and it would count as limited copyright fanfic in your case. And they'd own each story those writers make unlike fanfic that's already out there
