Creators of the shows you moron. Maxwell Atoms for instance was unaware his creations were used for this. Which is dissapointing since he did have input on the Billy and Mandy Power Stone clone.

Now answer the second question.
It's the polite and respectful thing to do since they can approve what and what not their characters would do. Nintendo did exactly that and shows deep respect for the creators.

They got most of the CN biggest series right. No Edds and Courage may be a dealbreaker to some but just 1 or 2 reps missing isn't a fatal flaw. The only really odd choice is Captain Planet and he's clearly meant to be this game's joke character so whatever.

Also not a dealbreaker, but a proper sequel was practically begging for Finn and Jake, Mordecai and Rigby, and probably Rex.
