I’m a small claims court judge and personally I would laugh these weak charges out of the courtroom and probably hold the prosecutor in contempt of court for even coming in here with this case
Associate Justice of the Supreme Court here. Anyone who thinks any of these charges would stick clearly flunked out of law school. The most you could charge him with is kidnapping, and even that would be a stretch to be honest.

It's weird because when you first watch it you think "this must be illegal". Maybe you don't even think it, it's like it's presupposed at a subconscious level. Then when you look into what the legal scholars have said about it, you realize, no, it isn't illegal, this could be happening right now and the law couldn't do a damn thing to stop it. That's scary. It's interesting to think that what seems like a silly horror movie is actually the greatest critique of the legal system since Harper Lee wrote To Kill a Mocking Bird. Truth is there is no justice. It's just you and your jigsaw, whoever or whatever that is. You're on your own. I think that's what James Wan was getting at. It's just a shame so many of us missed it.

I know this is supposed to be a bait-thread, but if you had actually watched the SAW films, you would have noticed that only Jigsaw's underlings were the ones who kidnapped the "victims".
Regardless it would be interesting to speculate what each accomplice would be charged with:
Hoffmann stabbed a few people at the end of Saw 7, so he would probably go to prison or even get the death penalty depending on the state. He also put Jill Tuck in a (probably) unwinnable trap at the end, which is basically murder.
Amanda set up unwinnable traps which would also land her in prison. She also shot Jeff's wife, but she was forced to by Hoffmann, so that might not count in the court of law.
Doctor Gordon did illegal operations on people, so he would have lost his medical license for sure. It is not clear if he himself help set up unwinnable traps, but if he did that would land him a defty sentence too.
Jigsaw couldn't be trialed for the simple fact that he is dead. There are fan theories that he survived, but I doubt it.

Jigsaw kidnapped a druggie in the 4th film all by himself at the pig festival. I think film 5 also shows him helping Hoffman kidnap the fat dude from the first film.
You're right about Jigsaws's first victim. The druggie named Cecil who also has relations to Amanda. So one case of kidnapping. I think Jigsaw found a legal loophole with the fat guy in the chain-fence labyrinth, by having Hoffmann do all the work. But I'd have to check the scene again to be sure.
Now that I think about it, he would have also had to have kidnapped Hoffmann, but as he is basically a mass-murderer, maybe the court wouldn't charge him on that.
