No, he was just going to be the judge. The part that scarecrow played.
Bane is not some throw-in-at-the-last moment plot element. The whole movie is based around the idea of that prison, which has nothing to do with the joker. And the joker playing judge shows what a bullshitter he was in the previous movie. He was always passing his personal judgement in TDK, but pretending to be chaotic neutral. He was a vengeful player, based on the "truck full of soldiers" story he tells Harvey.
His rulings always being "send them out on the ice" shows that he was never really ever giving anyone a choice of outcome, just framing it like it was.
