Batman locking up his rogue's gallery in Arkham knowing they'll inevitably break out and cause untold death, destruction, and general mayhem already reflects poorly on Batman. He puts his own principles above protecting the greater good.
Look dude. The comics code happened and they had to come up with an excuse for nobody to die. That made these characters stick around forever and go through a ton of refinement and development. So killing them off to have some random guy made in a week to take his seat would bore everyone, including the people who complain about not killing.
