I don't know about US law but in Britain and Ireland is netflix and Gadd who have to prove they didn't defame her and given people tracked her down within 48 hours they don't have plausible deniability since they aren't many people which have had restraining orders placed against them by politicians for stalking who happen to be female lawyers
As long as you don't use someone's actual name you can pretty much base any type of character you wish on that person. If he called Martha Fiona and changed the last name, even then it would be hard to prove. Also he has admitted to exaggerating certain parts of the story and he completely changed the name, and some court records support his story. So she has one hell of an uphill battle to climb. I also can gurantee you that he and the network can afford far better lawyers than she can.
I remember some other author in Britain tried to sue J.K. Rowling for using the name Harry Potter when she had already written a book about a Harry Potter. Needless to say Rowling's lawyers teared her to shreds. I guarantee you the network and Gadd's lawyers will do the same to hers.

You apparently don't follow court cases as much I do, in the U.S. and in the UK, I've seen plenty of times when restraining orders were denied, even when I thought the evidence was ample. I'm obsessed with court cases and the legal system inside and outside the US. It runs in my blood, I come from a very long line of lawyers.
