I'm pretty sure the current theory is just that they are going to rely on a combination of trademark and still having the copyright to newer versions on mickey to minimize the effect of steamboat willie entering public domain.

You honestly think a bill that increases the power of the biggest entertainment company on the planet has even a SLIGHT chance of passing?

        Anonymous

        Disney probably won't bother actually.
Since America's law system has basically allowed Disney to still hold the copy right to most uses of Mickey Mouse for the next 4 to 5 decades at least.

Since all that's going out of copyright is Steamboat Mickey, that means that only the Steamboat Mickey version of Mickey, or an original take on that character, counts as public domaine.
US law has determined that attributes of a public domain character introduced in later additions which would still be under copyright are still under copyright.
So Disney could sue any version of MM who talks squeaky or has a dog named Pluto or whatever.

And the internet has made normally low profile laws like stuff regarding public domain, bigger news. So more congressmen would be unwilling to do something unpopular, like sign another copyright extension

          Anonymous

And Disney has made the Mickey of Steamboat Willie the logo of their company, for which they can have permanent ownership as long as this is their logo.

            Anonymous

Not how it works, you can't claim back rights to public domain stuff just by putting it in your logo otherwise I could make my own company with the Mona Lisa for logo and make infinite money.

              Anonymous

I think the idea is to use trademark law to potentially limit uses of steamboat willie, especially that bit. I don't think it's a very strong legal argument, but knowing the reputation of Disney's lawyers, people might not want to risk it.

              Anonymous

              >Not how it works, you can't claim back rights to public domain stuff
It's not public domain yet and the logo already exists and is in use.

              Anonymous

              >I could make my own company with the Mona Lisa for logo and make infinite money.
You absolutely can use Mona Lisa in the name of your company, and as part of your logo. You can, for example, name your window installation company "Mona Lisa Stained Glass Co" and prevent other window installers from using Mona Lisa in their name. Trademark law is not about protecting your right as a creator, but protecting customers from confusion.
The bigger problem with Mickey Mouse is if you try to create original content with him. If you veer even slightly away from that original design, Disney may claim you have infringed on one of the myriad of later Mickey Mouse designs that are still under protection. All it takes is for one stupid judge to rule that Mickey with enclosed pupils is a unique non-obvious design element, and 99.9% of derivative fan art becomes technically infringing again.

Bro, Mario movie is feminism as frick

Movie Peach is such a Mary Sue it loops around to being misogynistic. She has no flaw or real personality, she's mostly there so the plot moves forward while more interesting characters like Bowser, Toad or DK take the spotlight. Even Mario is more interesting in the movie when in the games he's literally a blank slate. It's insulting, really.
