They choose who can stay and who can't on a case-by-case basis. Normally they wouldn't allow Sinister but he's useful to them so he can stay.
Cassandra was technically born in a mutant body and since her biology naturally and unconsciously did that they count her as a mutant.
Sinister is more of an edge case but they went with it because he is useful.

He isn't, the Ultimate Sinister is awful. It's been a while since I read those X-Men stories, but what I remember is he became a street thug and heard voices in his head to kill innocent people. When he went to jail he "created" Apocalypse using a mop bucket and broom handle with bed sheets and talked to it. It was fricking weird.
Some Ultimate versions of characters were clever, others were "how grimdurp can we make him?"

This. Up until Gillen he was your average badly written 90s villain trying to be written as scary & sinister.
Then Gillen wrote him as a flamboyantly camp witty English villian and he was bloody brilliant. And it was such a good take it's hard to remember that it's the antithesis of how he was originally.

Really like sinister, but i dont really think he should be counted as a mutant, the idea of a human scientist so obsessed with evolution that he changed himself to be more like a mutant is such a good antagonist for the x-men.

It's neat how upper right Sinister seems like classic Sinister, being dour. I'm imagining that he did all the nest stuff to himself- personality, memes from tv- to change how he was from his original self. It's an interesting implied in-universe personality change.

What? There's clearly 3 of them in the first panel, and you can tell it's the one getting injected who's in the following panels because of the speech font.
The speech font changes because he's adding new personality layers to himself.
I suppose that would be clearer if I had seen the preceding pages.
