Batman is not in charge of the coiuntry's juditial system, nothing is stopping the goverment from doing so, blame democrats, they keep letting criminals out.
Any random citizen in the DC universe can blow the Joker's brains out if they wanted but everyone acts like it's Batman's responsibility to murder criminals. It's not. Do it yourself if you want him dead so bad instead of whining that someone else won't do it.
Also, Batman is a traumatized and broken person who probably doesn't trust himself to make the right decision concerning life and death. We really take the Batman origin story for granted nowadays but actually think about it for a moment. His parents were murdered in front of him as a CHILD. And people wonder why he has this hang up about killing?

The problem is escalating Batman's villains past petty mob bosses and super powered crooks responsible more for property damage, kidnapping, and theft into actual mass murderers
If the law enforcement system of Gotham actually worked there wouldn't be a Batman in the first place and it's not Batman's responsibility to decide what happens with the criminals he captures.
Batman is just an IP farm, so they cant kill off any of their assets (including the villains). The problem lies with the writers and editorial who push for a "mature and realistic" representation, which clashes with the silly comicbookyness. They should simply apply the No-Kill-Rule on all characters... so instead of murder the villains would commit mischievous schemes and shenanigans. Which would justify Batman putting them only to prison/Arkham.
It'd be one thing if Batman was ever presented as some bleeding heart who truly believed that his enemies could and should be rehabilitated. But no, it's always presented as him having a narcissistic moral code about not killing because "it's bad".
