There's really not enough information so I'm afraid this is all just hot air. Still a really cool trailer but damn, I got all excited. Whoever animated it seems to really get the vibe of the original so well I got my hopes up.
It's a 'proof of concept' from a company that made a Medabots phone game (some team-based gacha thing, seems like there's strong design through-lines that could apply to Small Soldiers; it uses card-based equipment mechanics to make it 'toyetic,' which aligns with the end of the short).
My assumption is that they're fishing for the license with the style and effort, plus whatever buzz is generated.

Well it's meant to be a toy from a more modern franchise. The Gorgonites and the Commando Elite were based on GI Joe and Transformers. These new toys are based on something more like Overwatch or another franchise filled with butch strong female characters.

If Kevin is doing what he did with Medabots, he legally can't directly reference any of the original movie's characters.
What he did with Medabots was take advantage of a lapsed trademark. That allows him to use the name, but it doesn't grant him any ownership of prior iterations or the material within. That's why his Medabots game doesn't feature any of the pre-existing designs. He'd be violating copyright laws by using them.
The trailer not mentioning DreamWorks at all makes me think he found another lapsed trademark. He's managed to get some wins in his legal fight over Medabots, but DreamWorks isn't a small Japanese games publisher with no overseas offices.

Kevin Comadran. He's credited as "executive producer" at the end of this trailer. His company appears to have produced it.
The only other thing they've done is that Medabots mobile game. IIRC, he comes from a background in finance. That game is effectively unofficial and it's been the subject of various lawsuits around the world.

True…But personally I found them pretty entertaining, generic or simple doesn’t always mean bad. I believe that with good enough writing you can make ANY idea work and be enjoyable.
I mean - the whole point of Chip Hazard and the Commonado Elite was they were a walking assemblage of pro-military, propaganda-adjacent gung-ho American stereotypes. Just go back and watch Chip Hazard's speech - it's just a nonsense string of cliches and quotes from other media. It's effectively an anti-war/anti-military-industrial complex movie due to how it leans into showing why marketing that kind of thing to kids as a toy line is maybe not a great thing to be doing.
If they're smart with any kind of sequel/reboot, they'll pick out similar themes in current media and subvert them somehow. Maybe satirise girlboss capitalism with LE STRONG WOMAN military toys or something.

Doesn't look like it's going to be following up on the events of the movie. At the end of the movie the Gorgonites decided to go into the woods at yellowstone to build their own civilization. The commandoes got all blown up by an emp but the ceo of the company said he was going to sell the surplus toys to the military.

It occupies that same grey area roger rabbit did where it's technically a live action movie but has enough toons and toon-adjacent stuff in it to count.
Roger Rabbit was explicitly about cartoons and featured many prominent classic cartoon characters, there was never a gray area there and it's not really applicable to other movies where live action interacts with animated characters/environments unless they're acknowledged in-universe as being animated.

Maybe they end up on the Commando side if they die completely, making it harder for the kid if he doesn't protect his little pals. They'd run interference to slow down the Commando Elite's plans, so that the kid has time to show up and destroy their trap or take a bunch of them out if they're clustered and fighting Gorgonites.
