What a pussy lol. A pan-Atlantic C&D would be impossible to pursue for the company as well as him being totally in the legal clear.

If that was the title though he was encroaching on their trademark, not their copyright, and would just need to change the name of the project - not even the name of the character within the contents.

He just clearly has no spine or heart.

That's the way a lot of these "companies" for these old properties like Conan, Zorro, Tarzan, etc. work. Even if they don't have the rights because it's public domain, the intent is to scare people or failing that drown them in legal costs do fighting and winning isn't worth it. Would be nice if there were legal organizations that took these kinds of cases pro bono or whatever but that's not going to happen.

A cease and desist isn’t a lawsuit. They wouldn’t have gone any further even if he persisted. They’d have to actually prove there was monetary damage done.

The best lesson to learn is a C&D means absolutely nothing.

            It's a common business practice.
A cease & desist is essentially challenging someone to a game of chicken.

The difference is that Nintendo is insane enough to pursue legal action to the fullest. Remember, there's a dude who literally has to give up a 1/4 of his monthly earnings for the rest of his life to pay off Nintendo for selling hacking tools.

          >They wouldn’t have gone any further even if he persisted.
You've clearly never heard of Zorro Productions, Inc. who file lawsuits against anyone that uses the character even if they're only using material that's explicitly in the public domain. They've gone after Sony, people making musicals and even an Italian comedian who simply dressed up as Zorro and they'll fight these legal battles for years.

          >A cease and desist isn’t a lawsuit. They wouldn’t have gone any further even if he persisted.

No, they DID persist with someone else who ignored the C&D. There was a case about half a decade ago where CPI sued a guy from Spain who was doing Conan miniatures to sell. He sort of ignored the C&D and changed the names and then that was when CPI filed the lawsuit

They won mainly because the guy either couldn't go to New York or couldn't afford a lawyer to defend him on his behalf in New York, and prior to the lawsuit had been promoting his miniatures with Conan stuff that was still copyrighted (ie Frazetta Conan images). Hell, even one of his miniatures was going to be the Frazetta Conan pose

John Allison is in a better position on account his Conan webcomic is free. Having looked through his comic it may be that the issue is using the Conan name in the title and that his Conan looks too close to the copyrighted one. Wiki says the following:

          >Conan has "sullen", "smoldering", and "volcanic" blue eyes with a black "square-cut mane". Howard once describes him as having a hairy chest and, while comic book interpretations often portray Conan as wearing a loincloth or other minimalist clothing to give him a more barbaric image, Howard describes the character as wearing whatever garb is typical for the kingdom and culture in which Conan finds himself.

This might be why in most of the Cimmerian comics that reprint the Euro Conan tales, Conan is usually wearing pants rather than a loincloth. Honestly, Allison should just try to negotiate it, he's not making money from that webcomic other than advertising, is he?

Frazetta Conan isn’t at all the same. Those imaged are firmly copyrighted.

And I’d have to see the details, I would assume - again - the contention was actually trademark not copyright.

You mean for the lawsuit over the miniatures?

              https://www.courthousenews.com/wp-content/uploads/2018/08/Conan-figurine-pic-1.pdf

This was the evidence used in the case

Unlike the miniatures guy's Conan infringement, John Allison's Conan definitely doesn't look like Frazetta's version, but it might have some elements similar to other copyrighted Conan which might've gotten it on CPI's radar. Or it could just be because of the title.

Hey that reminds me, didn't Chuck Dixon put out two Conan novels last year, that made pretty clear it was the public domain version?

                >And even if he was the name Conan The Barbarian is a very different matter as that title goes to marvel in the 1970s.

It predates the Marvel title. "Conan the Barbarian" was used as the title of a 50s book collecting some of REH's stories:

                https://en.wikipedia.org/wiki/Conan_the_Barbarian_(1955_collection)

That said I think it should still be copyrighted unless somehow someone screwed up and didn't renew it. I don't know if there's another thing that used the name "Conan the Barbarian" that predates this though

You’re thinking of trademark. If the collected stories are all public domain they’re all public domain. Trademark is what he’s really up against.

But this is one of the rare times, just like I wished happened with that killer Winnie the Pooh, in which I’m all in favor of the creator being slapped down. He's not. Conan premiered in 1932, And even if he was the name Conan The Barbarian is a very different matter as that title goes to marvel in the 1970s. REH never actually used that title or branding. So basically Allison is a moron.

      >He's not. Conan premiered in 1932,

Which doesn't matter because John Allison lives in the UK. The original REH Conan has been public domain in the UK (and the rest of Europe) because they go by "life of author + 70" and not the 95 year rule. Since REH died in 1936, Conan went PD in the 2000s.

If Allison lived in the US then it'd be a little murkier because there's debate over whether various REH Conan stories (including the first) are public domain or not. Ablaze is able to publish the Conan stories from Europe under the name The Cimmerian for that reason.

If he got a cease and desist either he fricked up and used elements that came from later stories, or this is an intimidation tactic from the rights holders.

      https://en.wikipedia.org/wiki/Conan_the_Barbarian_(1955_collection)

That said I think it should still be copyrighted unless somehow someone screwed up and didn't renew it. I don't know if there's another thing that used the name "Conan the Barbarian" that predates this though

Yes, but the reverse is also true
People suddenly assume you can't use something because of trademark. If that were true Disney should've been able to stop Blood and Honey ftom being called Winnie-the-Pooh

The Conan rights holders seem to be getting aggressive about it because Titan currently has the rights (and they're located in the UK) and they won a suit against a guy in Spain who couldn't afford a lawyer

I love webcomics, but you have to understand there have always been shitloads of them. The last time when there were webcomics that you could assume everyone who has into webcomics read was... what? The heyday of Penny Arcade? Maybe XKCD for a few years before part of the audience grew out of their adolescent smug science phase? I heard about Scary Go Round and Bad Machinery from the usual sources, but here's a very simple fact about me: I hate "slice of life" garbage. Can't deal with it. So I never read them, and I don't know the creator's name.

And what was it with that time where people would give their webcomics a random name that had nothing to do with the subject matter?

        Anonymous

        >I love webcomics, but you have to understand there have always been shitloads of them.

Are there any more, though? Most of the college art kids doing their webcomics as a side project in their free time have aged out. Currently-updated webcomics are a fraction of what they were during the golden age in the 2000s.

It's not like I'm keeping a tally or anything. Things changed, of course. The barrier for entry was raised as more artists flooded into the hobby, and the artists there were already there (but were shit) got better. So it's relatively rare to see the old flavor of webcomic where a 16 year old with an anime obsession and the holy conviction his/her edgy musings were the mark of greatness picked up a stylus and just went to town. But it's not like webcomics are dying or anything. I regularly stumble upon active webcomics that have been going for years, and yet I never heard of them before. And that's without getting into Webtoons, obviously. Turns out there was a massive market for shitty romance. But the sort of comic I want to read on Webtoons is few and far between.

        >but here's a very simple fact about me: I hate "slice of life" garbage.

Another fact about you: you're very incurious and lazy and clearly don't bother to look past your first impressions.

Allison has been tending to his own little garden for decades but I wouldn't call his stories slice-of-life. Before this Conan tale, his project for the last couple of years was Steeple, about a priest fighting off witches, sea monsters, off-brand Transformers and his lodger's problematic advances in a West Country village.

Curious tactic, trying to convince me to read his shit by insulting me. But you'll note I mentioned his most well known webcomics, the ones I actually know about through people talking about them. Both are very firmly slice of life. Can I just like what I like? Because everything I've seen thus far still looks like the sort of twee nonsense I'm just not into. Literally all I'm saying is that there is no such thing as a universal like for any one artist or comic. Why do you have a problem with that?

      >yet there's never any sustained Conan threads here
You are aware that Conan is first and foremost a body of literary work, right? Of all people familiar with Conan, it's most likely that the largest part of them know him through the Arnie movies, the second largest part through the stories themselves, and only then we get into people for whom he's primarily a comic character. And I'd wager there are vast rifts between all of these groups. In short, it's likely that a lot of people who think this doesn't do justice to Conan don't read other Conan comics, either. And that's fine, because Conan is not a comics character, so they don't need to in order to form a well motivated opinion.
