Superman is supposed to be a good guy. Anyone "normal" would know that if they handcuff him and charge him correctly, Superman would confess and submit himself to jail time or any other consequences.
It could even lead into a plot about being purposefully sent to a bad/corrupt/evil prison to clean it up from the inside.
