When he finally did make a decision on impulse, showing some fire in his soul, it landed him in hospital, alone, in a foreign country. Yeah, Michael hated him and maybe he could have gotten Michael fired if he really wanted to, but what would that achieve? Toby already lived in the depths of despair, so how would firing Michael improve it? Not worth the effort? Better to just let it wash over him.
