It was weird hearing Superman call Billy Captain Marvel in Batman/Superman: Public Enemies movie. Wonder if either this or MK vs DC was the last time he was ever referred to that name.
There were actually some comics in the New 52 that accidentally referred to him as Captain Marvel. It was some Superman Annual during the Truth storyline.
It doesn't matter, there was never any issue with the two companies having characters that share the same name and there are many other examples of that besides Captain Marvel. DC just can't legally have a comic titled "Captain Marvel" but the character could always be called that. I have no idea why they gave it up, maybe they thought it would strengthen the character's brand or something, but it just made it more confusing by making his name the same as the wizard's name and also his magic word.
Going with Captain Thunder as suggested above isn't a bad alternative but they really should just put their foot down and go back to Captain Marvel. He's the original, he was the actual king of the Golden Age, they should be proud of that.
