Soulless as far Jax knows. Not every character has the same experience as Pomni. And even then there is still a existential debate on whether just cause Gummigoo (and probably all other NPC's) is programmed to simulate emotions as dread if that actually indicates geniune sentience or its simply a very convincing parlor trick.
If he managed to learn, do you think he would suddenly be empathetic towards them? I don't. As for your second point, not only is the author intent clear, I can't prove a negative.
Jax would probably argue that AI are not real people and are incapable of ever having actual sentience. Though whether he genuinely believes that or is just a massive is arguable.
As for author intent, what I got was it doesn't matter if Gummigoo was truly sentient or not because the experience the two had is meaningful to her and thus his "life" real or not has value.
