It's actually a legal grey area. Disney has started to use Steamboat Willie Mickey in logos specifically to try to claim this specific version as a trade-mark. This would have to be determined by a judge in a court case and it could go either way.
Disney can and will still use the characters though, Oswald the lucky rabbit expired earlier this year but he just got added to the Disney kart racer anyway
