      It seems that, on an eventual lawsuit, Penders is betting all his chips on the supposed fact that Sega has never taken legal actions against him for selling Archie Sonic-related merchandise.
      I'm not an expert, but it literally sounds as if his plea would be:

Penders wanted Sega to get involved (why he thought that was a good idea, no one knows), but Archie didn't because they feared Sega would not renew the license (that was about to expire) due to them being dragged into a legal mess that they started (remember, it was Archie who sued Penders). So, Archie decided to settle out of court, the details remain unknown.

          This last bit we know it due to Penders' statement seen in the DYKG video (of course, we should take them with a grain of salt, as Penders is a compulsive liar)

                He has not said it as such, but he always mentions the one time in a 2007-2008 Con when "Bioware people wanted to talk with me, but I wasn't in my booth, so they only greeted my wife and son".

                It seems he thinks that a clear undeniable evidence that Bioware wanted to:

                My biggest gripe regarding Penders and Chronicles, is that the game came out BEFORE he started copyrighting his shit.

                Thus, he has no right to say they were ripping him off, because even if Bioware indeed took "his" ideas and adapted them for a game, due to his WFH all of them belonged to Sega at the moment, therefore they didn't owe me neither money nor a mention in the credits.

                Honestly, how fricked up the legal system must be for the judge to not throwing out the case due to that, rather than because of the statute of limitations as it was the case?

        Yes, Ken doesn’t really own them, but Archie doesn’t really either, since they fricked up by having no original contracts.

        Sega was supposed to show up in court and claim ownership, which would have brought a court decision to Archie’s favor, but Sega refused.

        Archie told him they didn't have his contract anymore. It was after this that Penders, under the advice (if not influence) of his wife, started his copyright stunt, which eventually led to the Archie lawsuit.
        He always speaks about "his lawyers" or "his legal advisors", but many (me included) think it is only his wife.

          Agreed. And this is a reminder that I can get at least some semblance of what I want in life if I continue to apply myself. If even someone like Ken can get a caring, bread-winning life and still have a nice house and car after everything, surely I can get what I want as well.

      Penders was writing what might as well have been OC-centric AU sonic fanfiction before that sort of thing became widely available.
      Of course kids liked it, but that doesn't mean it was good.
      He was definitely one of the weakest writers on the team, but the comic's quality was already all over the place even without him. Hell if he wasn't such a litigious drama queen you'd probably see people unironically saying they liked his work just because it's what they grew up with.
      He's hated because he's an egotistical jackass. Not just because he's a shit writer.

          I think a big issue is the ugly airbrush he thinks is shading. It's a real amateur mistake first time digital artists make where they think it's an automatic shading tool. You can definitely make these stylized characters work and it's not very difficult, there's hundreds of junior artists in mobile game companies who pull this look off daily. He needs to learn about value buildup or shading with layer masks and also think about where the light is coming from
