There is no inconsistency. They are unable to consent to adult behaviors, and are also punished for breaking laws. They have more mental ability to discern right and wrong, and thus their responsibility to obey laws, but they are still too young to make adult choices. Your ten-year-old son is smarter than a baby so you would discipline him if he pissed on the floor, right? But would you do the same thing to a baby?
