The real reason that people keep the "Batman never kills" rule is tradition. In terms of trying to create a meaningful, complex character it's a stupid rule. They just do it because that's how it's normally done and they're scared to steer off course. So much of Batman's potential is limited by these writers always making him strictly in the confines of good and evil. Zach Snyder was genuinely the only one who got it right. Let him kill, let him disregard human laws
Originally he did kill before housewives complained. Read his pulp predecessors like The Shadow, The Spider, or The Whisperer for masked crimefighters who cut the crap and use guns and kill criminals.

You are correct. Golden Age superheroes were often way less corny or cheesy or gay than just about every generation of superheroes that came after them. That's because they evolved from the hero pulps where things were allowed to be more lurid.

CBM's work better when they try to balance their common self vs their superhero alter-ego. One of many Batman films failings is Bruce is rarely challenged to be in a sticky situation and Batman basically Deus Ex the whole thing.
